The role of notarial agreements in bankruptcies in Lyon in the 16th and 17th centuries: a private management of insolvency
Abstract
During the 16th century, Lyon reached a leadership position within the international market thanks to its fairs that used to attract merchants-bankers from all over Europe. Despite a court competent for insolvency cases that occurred during the fairs, merchants showed a marked preference for out-of-court solutions, frequently resorting to notarial agreements. Thus, Lyon notaries played a key role in the mediation of economic conflicts and maintained it also during the 17th century.
Grazie alle proprie fiere, la Lione del XVI secolo fu uno dei centri nevralgici dello scambio commerciale e finanziario internazionale. Il tribunale della Conservation aveva competenza sui fallimenti verificatisi per debiti di fiera. Tuttavia, i mercanti mostrarono una marcata preferenza per le soluzioni stragiudiziali, ricorrendo frequentemente agli accordi notarili. I notai lionesi, dunque, ebbero un ruolo fondamentale nella mediazione dei conflitti economici, che mantennero anche nel secolo successivo.
