"Amani judicis "or" a manu judicis "? The memory of a not respected procedural rule in a letter by the Archbishop William of Cagliari (1118)
Abstract
In 1118 the Archbishop William of Cagliari lodged a complaint to Pope Gelasius II accusing the “Giudice” of Cagliari, Mariano Torchitorio, to break the procedural rules concerning property donation to ecclesiastical institutions. Such rules had been demanded by the Apostolic See in order to prevent the sin of simony against which the Church had been fighting for years. A new complaint release makes it possible to acquire new data on the relationship between the Apostolic See and Sardinian “Giudicati” during the Middle Ages and correct some former interpretations.
Nel 1118 l’arcivescovo Guglielmo di Cagliari scriveva una lettera di denuncia a papa Gelasio II per informarlo che il giudice di Cagliari, Mariano Torchitorio, stava infrangendo le regole procedurali per la donazione di beni agli enti ecclesiastici. Tali regole erano state volute dalla Sede Apostolica per contrastare il peccato di simonia contro il quale la riforma della Chiesa lottava da anni. Una nuova edizione della lettera permette di acquisire nuovi dati sui rapporti fra Sede Apostolica e giudicati sardi durante il Medioevo e correggere alcune in-terpretazioni del passato.
