Pactism Legal Theories in Sardinia: Canales de Vega’s Discursos and Joan Dexart’s Capitula
Abstract
The 17th century saw the doctrinal consecration of the Sardinian legal system as a tool for the political equalization of Sardinia with the rest of the Aragonese territories. The Discourses of Canales de Vega and the Capitula de Dexart, outstanding representatives of the estates and officials of the king, contributed notably to this, with dogmatic-legal elaborations and developments that drew from the policies of the model known as pactism, transferring it to the reality of the island.
El siglo XVII vio la consagración doctrinal del ordenamiento jurídico sardo como herramienta de equiparación política de Cerdeña al del resto de territorios aragoneses. A ello contribuyeron de manera notable los Discursos de Canales de Vega y los Capitula de Dexart, destacados representantes de los estamentos y oficiales del rey, con elaboraciones y desarrollos dogamático-jurídicos que bebían de las políticas del modelo conocido como pactismo trasladándolo a la realidad de la isla.
